Deed Recording Requirements in Crow Wing County
All deeds recorded in Crow Wing County must meet the physical standards set by Minn. Stat. 507.093. Documents must be on 8.5 by 14 inch white paper, printed in black ink, with a font size of at least 8 points. The top of the first page must have a 3-inch blank margin reserved for the recording stamp. Documents that don't meet these standards will be returned without recording.
The auditor must certify that property taxes are current before any deed can be recorded. This requirement is in Minn. Stat. 272.12. The auditor's certification appears on the document before it goes to the Recorder. Without it, the Recorder won't accept the document. In practice, the title company or closing attorney handles this step as part of the closing process.
Under Minn. Stat. 507.34, recording protects the new owner against prior unrecorded claims. An unrecorded deed is void against a later buyer or lender who records first without notice of the earlier transfer. This rule explains why prompt recording is essential in every real estate transaction in Crow Wing County, whether it's a lakefront cabin, a residential lot in Brainerd, or a rural parcel.
When the property is a homestead, both spouses must sign. Minn. Stat. 507.02 requires both spouses to execute any deed conveying homestead property. A deed signed by only one spouse on a homestead is not complete and may be challenged. Always check whether the property is classified as homestead before preparing the deed.
Types of Deed Records Filed in Crow Wing County
The most common deed records in Crow Wing County are warranty deeds and quitclaim deeds. Under Minn. Stat. 507.07, a warranty deed includes the seller's promise that the title is good and that the seller will defend the buyer against any title claims. A quitclaim deed transfers the seller's interest with no such promise. Both types are used regularly in Crow Wing County, particularly for lake property, residential homes, and rural land transfers.
Contracts for deed are recorded in the county as well. Under Minn. Stat. 507.235, a contract for deed must be recorded within four months of being signed. This is common for rural and seasonal property in Crow Wing County, where sellers sometimes carry the financing directly. Recording the contract protects the buyer's interest against other claims on the property.
Transfer on death deeds offer a way to pass property without probate. Under Minn. Stat. 507.071, a property owner records a deed naming who gets the land at death. The deed is fully revocable while the owner is alive. It must be recorded before death to work. Many Crow Wing County cabin owners use this to pass lake property to children or grandchildren without going through probate court.
Deed Tax and Recording Fees
Crow Wing County collects deed tax at the time of recording. Under Minn. Stat. 287.21, the tax is 0.33% of the purchase price above $3,000. Sales at $3,000 or less pay a flat $1.65. The deed tax applies to the value of consideration paid for the property. For a typical home sale in Brainerd or a lake cabin transfer, the deed tax is a real cost to factor into closing expenses.
The recording fee for most deeds is $46. Additional pages may add to the fee. Copy fees apply when you request copies of recorded documents. The Recorder's office in Brainerd accepts payments in person. Contact the office or check the county website for the current fee schedule before submitting documents.
