Recording Requirements for Beltrami County Deeds
All deeds submitted to the Beltrami County Recorder must meet the document formatting standards in Minnesota Statute 507.093. The document must be dated, signed by all required parties, and acknowledged before a notary. The notarial certificate needs a date, a clear and legible notary seal, the notary's signature, and the commission expiration date. Marital status must be stated specifically in the document, and the full legal description is required. White-out is not allowed.
The recording fee is $46 per document. Deed tax is 0.33% of the purchase price under Minnesota Statute 287.21, with the Minnesota Department of Revenue overseeing deed tax administration statewide. A well disclosure fee of $54 is required when a well is present. For homestead properties, Minnesota Statute 507.02 requires both spouses to sign the deed. Missing that signature is one of the most common reasons a deed comes back rejected.
A document must meet the recordable standards under Minnesota Statute 507.24 to be accepted, covering things like legibility, proper execution, and required content. Staff will check these items before recording.
Types of Deed Records in Beltrami County
Warranty deeds, quitclaim deeds, and transfer on death deeds are among the most common instruments in the Beltrami County deed record archive. Warranty deeds offer the buyer a guarantee of clear title from the seller. Quitclaim deeds convey only the grantor's interest, with no warranty. Both types fall under Minnesota Statute 507.07, and both must be recorded to be effective against later buyers under Minnesota Statute 507.34.
Transfer on death deeds are recorded under Minnesota Statute 507.071 and allow a property owner to name a beneficiary who takes ownership at death, bypassing the probate process. Contracts for deed, governed by Minnesota Statute 507.235, are also recorded here. These installment purchase arrangements appear in the deed index and are binding against third parties once recorded. The Recorder also handles Torrens-registered parcels under Minnesota Statute Chapter 508, maintaining Certificates of Title for those properties.
